HomeScout Terms of Use

These Terms of Use (“Terms”) contain important information about your legal rights and obligations when using the HomeScout service, available at https://www.homescout.net (the “Service”).

When we refer to the “Service,” we also mean any component, feature, or functionality of the Service.

These Terms apply to anyone who registers for, accesses, browses, or uses the Service (“user” or “you”), whether you are:

• A Contractor seeking to provide home improvement or repair services, or

• A Homeowner seeking to find and hire a Contractor.

These Terms incorporate all other terms, conditions, rules, and policies posted on the Service, including our Contractor Terms & Conditions (available at https://www.homescout.net/terms-and-conditions), which are hereby included by reference.

If you use the Service on behalf of an organization, “you” also includes that organization.

The Service is operated by HomeScout (“HomeScout,” “we,” or “us”). Our processing of personal data in connection with your use of the Service is described in our Privacy Policy (https://www.homescout.net/privacy-policy).

By using the Service, you declare and warrant that you:

1. Have read, understand, and agree to be bound by these Terms in full.

2. Have the authority to enter into these Terms on behalf of your organization (if applicable).

3. Are of legal age in your jurisdiction.

4. Own the property or have the authority of the property owner to initiate repairs or renovations when acting as a Homeowner.

5. Will comply with these Terms and all applicable laws and regulations.

If you do not agree to these Terms, you must not use the Service.


HomeScout Services for Homeowners

To request services through HomeScout, Homeowners must provide accurate information, including their location, the type of services requested, and their contact details. Once submitted, Contractors may reach out directly to discuss the request.

Important: Homeowners and Contractors negotiate and enter into their own agreements for services. HomeScout is not a party to those agreements and does not guarantee the performance, pricing, timeliness, quality, or outcome of any Contractor’s work. We do not provide indemnification for any disputes or damages arising from Contractor services.

HomeScout will not participate in disputes between Homeowners and Contractors. By using the Service, you release HomeScout from all liability related to disputes with other users.

Contractors operate independently from HomeScout and may not represent themselves as our employees, agents, or partners. Neither party can bind the other to any contractual obligations.

Homeowners must provide truthful feedback to HomeScout about the services they receive (or do not receive). If a Contractor requests that you provide false or misleading information, you must report this to us immediately.


Intellectual Property

HomeScout Content

The Service and its content—including text, graphics, images, logos, software, videos, and other materials (“Content”)—are owned or licensed by HomeScout and are protected by intellectual property laws. You may not copy, modify, or redistribute Content without our permission.

We grant you a limited, revocable, non-transferable license to use the Service and its Content solely for the purposes of connecting with Contractors (if you are a Homeowner) or Homeowners (if you are a Contractor). All other rights are reserved.

Prohibited actions include:

• Using automated tools to scrape or collect data from the Service.

• Circumventing security measures.

• Reverse engineering or modifying the Service.

• Misrepresenting your identity or relationship with HomeScout.

Violation of these restrictions may result in termination of your account and legal action.


User Content

“User Content” includes any materials, feedback, or communications you provide through the Service. You grant HomeScout a worldwide, royalty-free, perpetual license to use, reproduce, and distribute your User Content for purposes related to operating and improving the Service.

By providing User Content, you represent that:

• You own the rights to it or have permission to share it.

• It does not infringe on the rights of others.

• It does not contain harmful software or illegal content.

We reserve the right to remove User Content that violates these Terms.


Use Restrictions

You may not use the Service to:

• Post or share pornographic, obscene, racist, or otherwise unlawful material.

• Harass, threaten, or impersonate others.

• Send spam or collect personal data without consent.

• Post false or misleading information.

• Promote contests or advertisements without our approval.

• Overload or disrupt the Service’s operations.

We may, but are not obligated to, monitor or remove content that violates these Terms.


Warranties and Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free operation, nor do we endorse or guarantee the services of any Contractor.


Limitation of Liability

HomeScout is not responsible for:

• Inaccurate or incomplete information on the Service.

• Contractor performance or misconduct.

• Any damages arising from your use or inability to use the Service.

To the fullest extent permitted by law, our total liability will not exceed the total payments you made to HomeScout in the 12 months preceding a claim.


Indemnification

You agree to indemnify and hold harmless HomeScout and its affiliates from any claims, damages, or expenses arising from:

• Your breach of these Terms.

• Your misuse of the Service.

• Disputes between you and other users.


Arbitration and Class Action Waiver

All disputes will be resolved through binding arbitration under the rules of the American Arbitration Association. Arbitration will take place in Philadelphia, Pennsylvania and be governed by the laws of Delaware.

You agree to bring claims only in your individual capacity and not as part of a class action. You may opt out of this provision within 30 days of first using the Service by emailing [email protected].


Electronic Communications

By using the Service, you consent to receive communications from us electronically. You may unsubscribe from promotional messages by following the instructions in the email.


Third-Party Services

Some Service features rely on third-party tools or platforms. HomeScout is not responsible for interruptions or limitations caused by these third parties.


Other Terms

We may transfer our rights and obligations under these Terms without affecting your rights. We may update these Terms from time to time; your continued use of the Service constitutes acceptance of any changes.

These Terms are governed by the laws of Delaware and applicable U.S. federal laws.
